1. OFFICIAL CODES: Unique official codes ("Codes") appearing on the back of Instant Win Stickers ("Stickers") are required to play. Stickers are attached to specially-marked packages of M-16 Serene, M-17 Concero, M-24 Powerview and M-31 Visio Tri-Ex Masks; SF-6 Imprex Tri-Ex and SF-5x Platina Plus Fins; RS-460 and RS-530 Regulators; BP-2 Backpack Bags; CBS Color Box sets; BCJ-1650 Passage, BCJ-6900 X-Pert BB and BCJ-6910 Selene Wing Buoyancy Compensating Jackets. 2. TO PLAY: Complete official entry form available at www.tusa.com (the "Website"), enter your Code, and follow on-screen instructions to proceed. You must use a different code each time you enter. Each entry will be deemed to have been submitted by the record holder of the e-mail address from which the entry originated. If after entering your Code you receive a "WINNER" message, you will win the prize indicated, subject to verification.

4. INSTANT WIN PRIZE CLAIMS: To claim prize, follow the directions concerning the winner's affidavit eligibility and liability release, which will appear after the prize-winning message. Prize winners will be notified approximately 4 weeks after verified claim. Allow 6-8 weeks for delivery of prizes. Unclaimed prizes will be awarded in a Second Chance Drawing described below (assuming sufficient number of eligible entries). No more than the stated number of prizes will be awarded. In the unlikely event that winning messages for any prize level are distributed in numbers greater than the number stated in these rules for such prize level, that stated number of winners will be selected in a random drawing from among all verified prize claims received for that prize level.

5. SECOND CHANCE Drawing: Any prize not claimed by 9/30/08 will be awarded in a Second Chance Drawing, assuming a sufficient number of entries. Each time you play the Game and do not win a prize, you will be automatically entered in the Drawing. You also may enter by printing your name, address, telephone number, email address and age on a 3" x 5" piece of paper and mailing it to: TUSA $100,000 Prize Giveaway, Tabata USA Inc., 2380 Mira Mar Ave., Long Beach, CA 90815. ALL SECOND CHANCE DRAWING ENTRIES MUST BE RECEIVED BY 8/31/08. No illegible, incomplete, forged or altered entries or mechanically reproduced mail-in entries will be accepted. Winners will be determined from all eligible entries received in a random drawing to be conducted on or about 10/20/08. Enter as often as you wish, but each entry must be submitted separately. Odds of winning depend upon the number of eligible entries received. Winners will be notified by email. All entries become the property of the Sponsor and will not be returned.

6. ELIGIBILITY: Game/Drawing open to individual legal residents of the United States, excluding Rhode Island, District of Columbia, Puerto Rico and U.S. territories and possessions), age 13 years or older as of 2/1/08, except employees (and their immediate families and members of the same household) of Sponsor, its affiliates, agents, judges and advertising and promotion agencies.

7. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Prize claims subject to verification, and drawing to be conducted, by Sponsor, whose decisions are final on all matters relating to this Game/Drawing. Winners will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be awarded to alternate winner if affidavit is not returned within 14 days after mailing to winner, if prize notification email or prize is returned as undeliverable or if 3 attempts to contact entrant by phone are unsuccessful. If prize is won by a minor, it will be awarded in the name of a parent or legal guardian in SponsorÕs sole discretion. Winners agree to use of name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to minors to be subject to prior approval of parent or legal guardian. Prize claims and entries are sole property of Sponsor and will not be returned.

8. GENERAL: This Game/Drawing is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Game/Drawing will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Game/Drawing must be brought in a court of competent jurisdiction within the United States of America. Sponsor and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Sponsor and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's e-mail account to receive e-mail messages. The use of automated software or computer programs to register for or to play the Game/Drawing is prohibited and any individual who uses or attempts to use such methods to register or play will be disqualified. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Game/Drawing, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Game/Drawing should any virus, bug, technical failures, unauthorized human intervention or other causes beyond SponsorÕs control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game/Drawing. In the event of any such cancellation, termination or suspension, a notice will be posted on the Website and a random drawing will be held from among all eligible, non-suspect entries received for the Second Chance Drawing prior to such time. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of his or her entries) from this Game/Drawing or any other promotion conducted now or in the future by Sponsor or any of its affiliates if he tampers with the entry process or if his or her fraud or misconduct affects the integrity of the Game/Drawing. Sponsors reserve the right to correct clerical or typographical errors in promotional materials. By participating in this Game/Drawing, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Game/Drawing. By accepting prize, winner agrees to release Sponsor, its directors, employees, officers, and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activity.

9. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME/DRAWING IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
